Jask Technologies, LLC, the owner and operator of Drainn.com (“Drainn”), is a paid direct messaging platform that enables adult content creators (“Creators”) to offer paid direct messages (“Conversations”) with their fans (“Fans”). While all users are required to comply with our Terms of Service, Creators should also follow these Creator Guidelines to ensure that Drainn remains a safe space for all users. These Creator Guidelines (“Guidelines”) govern both the Content posted by Creators and the activities of those Creators while interacting with Fans and other Creators or otherwise using Drainn.
We are committed to encouraging Creator expression and to ensuring that all Content on Drainn is legal, safe, and enjoyable for Fans. To assist in these efforts, Creators should not post, upload, or share Content that violates these Guidelines or credit card association rules.
We may remove any Content that describes or depicts – whether real, simulated, or implied:
Minors, including age-play or adult baby/diaper lover toys and costumes.
Lack of consent, such as sexual assault, kidnapping, hypnosis, intoxication, sleeping/passed-out, up-skirt, violence, sadomasochistic abuse, hardcore bondage, weapons, or asphyxiation.
Bestiality, including monstrous humanoids or animal-themed sex toys.
Torture, such as oversized toys, genital mutilation, or extreme fisting.
Incest, such as sexual activity between blood or legal relatives.
Self-harm, including suicidal ideations and cutting.
Necrophilia, such as corpses and coffins.
Bodily fluids including scat, urine, lactation, vomit, and blood, but excluding semen, female ejaculation, and saliva.
We may also remove any Content which advertises, promotes, encourages, facilitates, or solicits the use of illegal goods or services, including prostitution, human trafficking, and illicit drugs.
We are committed to ensuring that every individual depicted on Drainn consents to the production and publication of the Content on Drainn. To assist in these efforts, we place additional restrictions on Creators who post Content that depicts one or more third parties (“Content Depicting Third Parties”). Creators who post Content Depicting Third Parties should ensure that:
The Content Depicting Third Parties does not violate any third party’s rights.
Each individual depicted in the Content Depicting Third Parties is registered as a Creator on Drainn.
Each Creator depicted in the Content Depicting Third Parties is tagged therein.
Government-issued identification documentation and other necessary records are obtained and maintained to confirm that each Creator depicted in the Content Depicting Third Parties was at least eighteen (18) years of age when such Content was produced.
Written documentation is obtained and maintained to confirm that each Creator depicted in the Content Depicting Third Parties has consented to (i) being depicted in the Content Depicting Third Parties, and (ii) the Content Depicting Third Parties being publicly distributed on Drainn.
Upon request, Creator should promptly provide us with these records, documents, and any other requested releases, licenses, grants, or registrations. We may refrain from publicly distributing any Content Depicting Third Parties until all depicted Creators have confirmed their identity, consented to being depicted in the Content Depicting Third Parties, and consented to the Content Depicting Third Parties being distributed on Drainn.
We are committed to ensuring that Fans get the benefit of their bargain. In other words, we want Fans to get what they pay for. To assist in these efforts, Creators should ensure that all representations made to Fans in furtherance of licensing Content on Drainn are lawful, including that such representations are truthful and not misleading. Creators should follow all laws, rules, and guidelines issued by the Federal Trade Commission or any similar state agency that may pertain to rules against deceptive or unfair trade practices. For example, Creators should:
Provide an accurate description of the Content, including whether the Content depicts nudity or sexual activity and the type of nudity or sexual activity that is depicted.
Not fraudulently pass off recorded Content as a live stream.
Adequately disclose if third-party chatters are used to interact with Fans.
Only remove or terminate Content for legitimate business reasons or as otherwise required by law.
We are committed to ensuring that Creators remain safe while producing the Content. To assist in these efforts, Creators should not:
Upload or broadcast any Content depicting nudity or sexual activity where any individual is not readily identifiable within the Content, such as where any individual’s face is hidden or obstructed for the entirety of the performance.
Allow a third party to use the Creator’s keyboard during any live stream.
Record or broadcast Content depicting nudity or sexual activity from any public place where members of the public are reasonably likely to see the Content.
We are also committed to ensuring that all users remain safe while using Drainn. To assist in these efforts, Creators should not:
Release the personal information of any other user or third party without that person’s consent.
Harass, disparage, defame, or otherwise interfere with the business or personal lives of other users, whether on Drainn, on third-party websites, or offline.
Solicit or accept payments for travel or in-person meetings.
Defraud us or our users (e.g., working together with a member or “hacker” to accept payment with stolen credit cards).
We may delete the account of any Creator who violates, attempts to violate, or assists or permits any person in violating these Creator Guidelines. Creators who are aware of any Content on Drainn that violates these Creator Guidelines, or of any other Creator who is violating these Creator Guidelines, should fill out our Complaints form immediately. Please provide as much detail as possible, including a description of the objectionable Content or the location where that Content may be found, the username of the Creator engaging in suspicious activities, the date and time of identification, the reason we should remove the objectionable Content or investigate the activities, and a statement certifying the accuracy of the information provided to us.
